§1. General Provisions
These regulations define the terms and conditions for the provision of electronic services by Fundacja Centrum Fotografii, based in Bielsko-Biała, ul. Stefana Batorego 5, 43-300 Bielsko-Biała, registered in the Register of Associations, Other Social and Professional Organizations and Foundations maintained by the District Court in Bielsko-Biała, VIII Commercial Division of the National Court Register under KRS number 0000223157, NIP: 5472015804, REGON: 07293196900000 (hereinafter: the “Foundation”).

Electronic services are provided through the Foto Art Festival online store available at: www.fotoartfestival.com.

Electronic services are available until two calendar days before the start of the Foto Art Festival.

§2. Definitions

• Electronic Service – a service provided electronically, in particular the sale of tickets and passes in electronic form (PDF file).
• User – a person using the electronic services of the Foundation via the online store.

§3. Scope of Electronic Services
The Foundation provides electronic sales of tickets and passes for events and exhibitions organized as part of the Foto Art Festival.

The service consists of delivering a ticket or pass in PDF format to the email address provided by the User during the order process.

§4. Conditions of Service Provision
Electronic services are provided until the date specified in §1.

The Foundation will make every effort to ensure the service is provided without interruptions, but is not responsible for disruptions caused by factors beyond its control, including network failures or force majeure.

Electronic services are paid, with the price indicated at the time of ordering.

§5. Conclusion of the Electronic Services Agreement
The agreement is concluded at the moment the Foundation confirms acceptance of the order for the electronic service.

Confirmation of service provision occurs by sending the electronic ticket or pass to the email address provided.

§6. Rights and Obligations of the User

• The User is obliged to provide accurate contact information, particularly a valid email address.
• The User must use the service according to its intended purpose and in compliance with the law.
• The User is responsible for securing their own equipment and software necessary to use electronic services.
• The User should promptly report any irregularities related to the services provided to the Foundation.

§7. Withdrawal from the Agreement and Refunds
Due to the nature of the electronic service – delivery of tickets and passes in PDF format – once the service has started (file sent), the right of withdrawal without giving a reason does not apply, in accordance with Art. 38(12) of the Consumer Rights Act.

In the case of defective service provision, the User has the right to file a complaint.

§8. Complaints
Complaints regarding electronic services can be submitted in writing to the Foundation’s email address: info@fotoartfestival.com.

Complaints will be resolved within 14 days from the date of receipt.

§9. Personal Data Protection
The Foundation processes Users’ personal data in accordance with the Privacy Policy available on the store’s website.

Detailed rules for data processing are regulated in a separate Privacy Policy document.

§10. Final Provisions
The Foundation reserves the right to amend these Regulations. Changes do not affect agreements already concluded.

Matters not regulated in these Regulations are governed by the provisions of the Civil Code and the Act on the Provision of Electronic Services.

Disputes arising from the use of electronic services will be resolved by the competent court according to the Foundation’s registered office.
