§1. General Provisions
The Foto Art Festival online store, hereinafter referred to as the “Store,” is operated by Fundacja Centrum Fotografii, based in Bielsko-Biała, 43-300, ul. Stefana Batorego 5, registered in the Register of Associations, Other Social and Professional Organizations and Foundations maintained by the District Court in Bielsko-Biała, VIII Commercial Division of the National Court Register under KRS: 0000223157, NIP: 5472015804, REGON: 07293196900000.

The Store operates at: www.fotoartfestival.com.

These Terms and Conditions define the rules for using the Store, including rules for placing orders, sales, and product delivery.

§2. Store Offer
The Store offers the following products:
a) Tickets for events organized as part of the Foto Art Festival,
b) Admission tickets and exhibition passes (hereinafter collectively referred to as “Tickets”),
c) Festival catalogs, t-shirts, bags, and other merchandise (hereinafter referred to as “Physical Products”).

Electronic tickets, passes, and other digital products are delivered exclusively via email in PDF format to the email address provided by the Customer. Each ticket contains a unique identification number.

Physical products are collected exclusively in person at the Festival Office during the Foto Art Festival at the address provided in the “Contact” section on the official festival website: www.fotoartfestival.com. The Store does not provide shipping via courier or postal services.

§3. Placing Orders and Concluding the Agreement
Orders can only be placed through the online Store.

To process an order, the Customer must provide accurate contact information, including a valid email address and, for physical products, any necessary details for identification and collection.

The sales agreement is concluded upon the Foundation’s confirmation of the order.

For tickets and electronic products, order fulfillment is confirmed by sending a PDF file to the Customer’s email address.

For physical products, the Customer will be informed of the possibility to collect the items at the Festival Office.

§4. Payments
All prices are in Polish zloty (PLN) and include VAT.

The Customer may make payments using available Store methods, including electronic bank transfer, card payment, or online payment systems.

Orders are processed once payment has been received and confirmed on the Foundation’s account.

§5. Delivery
Electronic tickets and passes are sent to the Customer’s email address no later than 5 business days after payment confirmation. In case of delays, the Foundation will inform the Customer about the order status.

Physical products are not shipped and must be collected in person at the Festival Office during working hours listed on the festival website.

Failure to collect physical products within the designated period will result in the cancellation of the order. The Foundation will attempt to contact the Customer to determine further action. If collection does not occur and no agreement is reached, refund requests will be considered individually, accounting for any administrative costs.

§6. Returns and Complaints
Due to the nature of electronic products (tickets, PDF passes), the right to withdraw from the contract or return such products does not apply once the file has been delivered to the Customer’s email.

Physical products can be returned in accordance with applicable consumer law, provided they are unused and in original condition.

Complaints regarding orders may be submitted in writing to the Foundation via email ([Foundation email address]) or by post. Complaints will be addressed within 14 days of receipt.

If a complaint is upheld, the Foundation will promptly remedy the defect or refund the payment.

§7. Collection by an Authorized Person and Identity Verification
Physical products may be collected by a person other than the one listed in the order only with a written authorization containing the date and signature of the ordering person.

Failure to provide such authorization will result in refusal to release the order.

For identity verification, the Foundation may request an official photo ID (e.g., ID card or passport) to visually compare the data with the order or authorization.

The Foundation does not keep records or make copies of IDs—the verification is solely visual to protect the rights of the Customer and the Foundation.

§8. Personal Data Protection
The Foundation processes Customers’ personal data in accordance with applicable law and the Privacy Policy available on the Store website.

Data provided when placing an order is used solely to process the order and contact the Customer.

§9. Final Provisions
The Foundation reserves the right to amend these Terms and Conditions. Changes do not affect orders already placed and confirmed.

Matters not regulated herein are governed by the Civil Code and other applicable laws.

Any disputes arising from using the Store will be resolved by the competent court based on the Foundation’s registered office.

The Foundation is not responsible for failure or delay in order fulfillment resulting from force majeure, including IT system failures, random events, natural disasters, or other unforeseen circumstances beyond the Foundation’s control.
